Hewitt Gas Co. LLC

Terms & Conditions

Draft prepared September 9, 2026

These Terms of Service (“Terms”) apply to services performed by Hewitt Gas Co. LLC (“HGC,” “we,” “us,” or “our”). By authorizing HGC to perform work, the customer acknowledges and agrees to the following terms.

1. Scope of Work

HGC will perform only the work described in the applicable estimate, work order, invoice, or other written agreement.

Services may include, as permitted by applicable licensing requirements:

Work outside the agreed scope requires customer authorization and may result in additional charges.

2. Estimates and Unforeseen Conditions

Estimates are based on conditions reasonably observable before work begins.

Gas piping, fireplaces, chimneys, walls, crawlspaces, attics, concealed utilities, appliance components, and other portions of a property may contain conditions that cannot reasonably be identified until work begins.

If HGC discovers conditions requiring additional work, materials, labor, permits, or specialized services, the customer will be informed before additional billable work is performed whenever reasonably practical.

An estimate is not a guarantee that concealed or previously unknown conditions will not affect the final price.

3. Existing Equipment and Previous Work

HGC is not responsible for defects, code violations, deterioration, improper installation, modifications, damage, or unsafe conditions that existed before HGC began work.

Service or repair of one component does not mean HGC has inspected, approved, certified, or accepted responsibility for the entire appliance, gas piping system, venting system, chimney, electrical system, or property unless specifically stated in writing.

If an unsafe condition is discovered, HGC may stop work or decline to operate affected equipment until the condition is corrected.

4. Fireplace and Gas-Log Service

Cleaning, maintenance, troubleshooting, or inspection represents the condition of the equipment at the time service is performed.

Unless specifically stated otherwise in writing, fireplace or gas-log service is not a warranty that:

Normal deterioration, component failure, corrosion, contamination, environmental conditions, and changes occurring after service are outside HGC's control.

5. Gas Leak and Pressure Testing

When HGC performs a gas leak or pressure test, the results apply to the system and conditions accessible and tested at that time.

Passing a test does not guarantee that a future leak or failure cannot occur.

If an existing system fails testing, additional diagnostic or repair work is outside the original testing charge unless specifically included in the agreed scope.

HGC will not knowingly place an unsafe gas system or appliance into operation.

6. Customer-Supplied Equipment and Materials

HGC may, at its discretion, install customer-supplied appliances, fireplaces, gas logs, conversion kits, parts, or other materials.

The customer is responsible for ensuring customer-supplied equipment is correct, complete, undamaged, approved for its intended application, and compatible with the property and fuel supply.

HGC does not warrant customer-supplied equipment or materials.

Additional labor resulting from missing, incorrect, damaged, defective, or incompatible customer-supplied equipment may be charged separately.

7. Gas-Type Conversions

Gas appliance conversions will only be performed when the appliance is approved for conversion and the appropriate manufacturer-approved components and instructions are available.

HGC may refuse to convert equipment that cannot be safely or properly converted.

HGC does not guarantee the condition or future performance of an existing appliance merely because a conversion was successfully completed.

8. Permits and Inspections

Permits and inspections will be obtained when required by applicable law and when included within HGC's contracted scope.

Permit and inspection fees may be charged to the customer unless expressly included in the quoted price.

HGC is not responsible for delays caused by permitting authorities, inspectors, utilities, weather, product availability, or other circumstances outside HGC's reasonable control.

HGC will not obtain permits or assume responsibility for work performed by others unless HGC expressly agrees in writing to do so.

9. Access to Property

The customer is responsible for providing reasonable and safe access to the work area, gas meter or propane supply, appliances, crawlspaces, attics, electrical equipment, and other areas necessary to perform the agreed work.

Additional charges may apply when unusual access conditions materially increase the labor required.

HGC may refuse to enter or work in an area that presents an unreasonable safety hazard.

10. Property Protection

HGC will use reasonable care while performing work.

Some installations and repairs inherently require drilling, cutting, removal of materials, or access through walls, floors, cabinetry, masonry, landscaping, or other finished surfaces.

Unless specifically included in the written scope, painting, drywall repair, masonry repair, carpentry, landscaping, finish work, and cosmetic restoration are not included.

HGC is not responsible for unavoidable damage resulting from access reasonably necessary to perform authorized work, provided reasonable care is exercised.

11. Customer Authorization

The customer represents that they are the property owner or otherwise have authority to authorize the requested work.

The customer authorizes HGC to shut off and restore gas, electricity, appliances, or other systems when reasonably necessary to perform the contracted work.

12. Payment

Payment is due upon completion of service unless different payment terms are stated in writing.

Deposits or progress payments may be required for larger projects, special-order equipment, or material purchases.

Additional work authorized by the customer will be added to the final invoice.

Returned payments, chargebacks, collection expenses, and other unpaid balances may be subject to reasonable fees to the extent permitted by law.

13. Cancellations and Scheduling

Customers should provide reasonable notice when canceling or rescheduling an appointment.

HGC reserves the right to charge a cancellation or trip fee for appointments canceled without reasonable notice, inaccessible properties, or situations in which HGC arrives but cannot perform work because necessary access or authorization was not provided.

Any applicable fee will be disclosed when reasonably practicable.

14. Workmanship and Warranty

HGC warrants that work performed by HGC will be completed in a professional manner consistent with applicable requirements.

Manufacturer warranties apply to equipment and components according to the manufacturer's terms.

Unless otherwise stated in writing, HGC's workmanship warranty does not cover:

15. Work Performed by Others

HGC is responsible only for work actually performed by HGC.

HGC assumes no responsibility for work performed before or after its service by property owners, other contractors, utilities, appliance installers, or other third parties.

Modification of HGC's completed work by another person may void any applicable HGC workmanship warranty relating to the modified work.

16. Limitation of Responsibility

To the fullest extent permitted by applicable law, HGC will not be responsible for indirect, incidental, or consequential losses resulting from equipment failure, interruption of gas service, concealed conditions, pre-existing defects, or matters outside HGC's reasonable control.

Nothing in these Terms is intended to waive or limit responsibility that cannot legally be waived or limited under applicable law.

17. Photographs and Documentation

HGC may photograph or otherwise document equipment, piping, installation conditions, test results, and completed work for business records, warranty documentation, insurance purposes, code compliance, and dispute resolution.

Photographs identifying the customer or property will not be used for advertising without appropriate permission.

18. Right to Refuse or Stop Work

HGC reserves the right to refuse or discontinue work when conditions are unsafe, unlawful, outside HGC's licensed or insured scope, materially different from those represented by the customer, or otherwise unsuitable for proper completion.

The customer remains responsible for authorized work already completed and materials already provided or specially ordered.

19. Entire Agreement

The applicable estimate, work order, approved change orders, invoice, and these Terms collectively constitute the agreement between HGC and the customer regarding the work performed.

If a written estimate or contract contains terms that specifically conflict with these general Terms, the more specific written terms for that project will control.

20. Governing Law

These Terms and services performed by HGC are governed by the laws of the Commonwealth of Virginia.
